PLAINTIFF PERSONAL INJURY CLAIMS

Susan practises in personal injury claims on behalf of injured plaintiffs and specialises in:
  • Work accidents master and servant litigation;
  • Public liability claims;
  • Professional negligence claims;
  • Motor vehicle accidents.
Susan has a particular interest in workplace health and safety issues and in workplace accidents.

Susan has experience in superannuation disputes.

RESULTS

  • Susan has acted for plaintiffs in quadriplegic and large brain damage cases;
  • Willett v Futcher through this very recent case Susan has developed an expertise in dealing with the issue of trustee fees in respect of injured plaintiffs requiring their awards of damages to be looked after either by the Public Trustee or a private trustee provider.

PHILOSOPHICAL APPROACH TO CLAIMS

One of the consequences of the industrial revolution was recognition that human life and a safe working environment free from risk of injury was both a moral and social necessity. The law compels those who negligently harm individuals to provide compensation if the injured individual chooses to seek it. Individuals seek compensation because they suffer financial hardship or sustain injury or illness from which they will never fully recover.

The role of the plaintiff lawyer is to ensure that those injured individuals do not compromise their claim for a sum that is less than what the law entitles them to. That is, to ensure that each plaintiff receives just and adequate compensation.

The obligation of a plaintiff lawyer is to educate clients in respect of matters of law applicable to their claim so that the plaintiff can make their own informed decision regarding the conduct of their litigation. The challenge to a plaintiff lawyer is to convince sceptics that the individual is deserving of compensation for the harm suffered.

Susan is a regular contributor to newsletters and conducts seminars for clients.

Susan is:
  • Currently completing a Master of Laws;
This will provide Susan with the ability to advise on topics such as:
  • The liability of airlines for injury to passengers and damage to their property as a consequence of international aeroplane travel;
  • The liability of the aviation industry for damage to property on the ground as a consequence of flight;
  • The application of the Civil Liability Carriers’ Act (Cth);
  • The rights of the individual concerning terrorist attacks, hijackings, airline crashes, bomb threats and any unexpected or unusual incident occurring in the course of flight from which a passenger suffers injury.
  • An avid hockey player and administrator.
