An Application for Relief in Relation to Termination of Employment must be made to the Australian Industrial Relations Commission in the appropriate form within 21 days from the day on which the termination took effect.

As an employer, if you have been served with an Application for Relief in Relation to the Termination of someone’s employment consideration should be given as to whether the application has been properly brought. If an exclusion to the jurisdiction of the Australian Industrial Relations Commission applies a Motion to Dismiss the Application must be filed. A Motion to Dismiss the application could be brought on the basis of any of the above exclusions or for other reasons.
