Financial Agreements

Integrity, Vision, Achievement
There are three types of financial agreements that may be entered into by parties to a marriage.  These are:
  • Agreements before marriage (colloquially referred to as pre nuptial agreements)
  • Agreements during marriage; and
  • Post divorce agreements.
These agreements will bind the parties to them in respect of the property of the marriage and, if it desired to do so, other matters such as spousal maintenance.
 
In Queensland, there are two types of recognised agreements that may be entered into by parties to a de facto relationship. These are:
 
  • Cohabitation agreements; and
  • Separation agreements.

After separation, care should be taken when considering whether to enter into a binding agreement or a consent order with respect to property settlement.  Whilst there is no necessity for Court approval of a binding agreement as with a consent order, both parties are strongly advised to obtain independent legal advice when entering into a binding agreement. This is because the Court will not make any order which is inconsistent with a binding agreement at a later date unless certain circumstances apply.
